1. Introduction

Welcome to Inkko, a sketchy drawing tool designed for use within the Canva platform. Inkko is published and operated by Mr. Paolo Straet (“we,” “us,” or “our”). By accessing or using Inkko, you (“User,” “you,” or “your”) agree to be bound by the following terms, privacy practices, and support guidelines. If you do not agree with any part of this document, you must not use Inkko.

This document combines the Terms of Service, Privacy Policy, and Support Information into a single, unified page for your convenience.

2. Description of Inkko

Inkko is a creative tool that enables users to generate hand-drawn style shapes and illustrations with a natural, artistic aesthetic. You can draw rectangles, circles, ellipses, polygons, freehand strokes, and arrows using customizable stroke colors, fill colors, and fill patterns (solid, hachure, zigzag, cross-hatch, dots, dashed, zigzag-line). Inkko leverages the Rough.js library to render shapes with a rough, hand-drawn look, and uses icons from the Phosphor Icons library for its interface.

All created elements are exported as PNG images and inserted directly into your Canva designs. Inkko operates exclusively within the Canva platform and cannot function independently.

3. License to Use

Subject to your full compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Inkko solely for personal or internal business purposes, strictly within the Canva platform and in accordance with its intended functionality.

Mandatory Restrictions

You are strictly prohibited from:

Copying, decompiling, reverse engineering, disassembling, or attempting to derive the source code of Inkko or any part thereof.
Distributing, selling, renting, leasing, lending, assigning, or sublicensing Inkko.
Using Inkko in any way that damages, disables, overburdens, disrupts, or impairs the Application, our servers, the Canva platform, or connected networks.
Using Inkko for any illegal, fraudulent, unauthorized, or unethical purpose, or in violation of these Terms or Canva’s terms of service.

4. Relationship with Canva

Inkko functions entirely within the Canva platform. Your use of Canva is governed solely by Canva’s own Terms of Service and Privacy Policy, which are separate from these Terms. We are not responsible for Canva’s features, availability, policies, data handling, or any actions taken by Canva. Any interaction between you and Canva is independent of your relationship with us.

5. Intellectual Property

a) Our Property

All rights, title, and interest in Inkko—including its software code, architecture, user interface, graphics, text, logos, trademarks, and underlying technology—are owned exclusively by Paolo Straet and/or our licensors. Inkko incorporates third-party open-source libraries (Rough.js and Phosphor Icons), used under their respective licenses. These Terms do not transfer any intellectual property rights to you, except for the limited license granted in Section 3.

b) Your Created Content

You retain full and exclusive ownership of any original sketches, shapes, or illustrations you create using Inkko. We claim no rights over your content. You are free to use, modify, or distribute your creations as you see fit, subject to applicable laws and Canva’s policies.

6. Your Responsibilities for Content

You are solely responsible for all content you create or upload using Inkko, including its use in Canva designs or elsewhere. You agree that your content will:

Not infringe any third-party rights (copyright, trademark, image rights, moral rights, etc.).
Comply with all applicable local and international laws.
Adhere strictly to Canva’s Terms of Use and Content Policies.

You are responsible for ensuring your creations do not violate the rights of others. We do not monitor or review your content.

7. Privacy Policy

We respect your privacy and are committed to minimizing data collection. Inkko is designed to protect your personal information by default.

a) Information We Do NOT Collect

Inkko does not collect, store, transmit, or process any personally identifiable information (PII), including:

Your name, email address, or contact details.
Your Canva account ID or credentials.
Any content from your Canva designs (images, text, layouts, etc.).
Usage analytics, session data, or behavioral tracking.

We do not use cookies, web beacons, tracking pixels, or any other tracking technologies.

b) Aggregated, Anonymous Data

Canva may collect non-identifiable, aggregated usage data (e.g., frequency of shape usage, pattern selections) to analyze performance, fix bugs, and improve features. This data contains no personal identifiers and cannot be linked to you.

c) Third-Party Services

Inkko relies on the Canva platform. Canva has its own privacy practices, which govern how your data is handled while using Canva. We encourage you to review Canva’s Privacy Policy.

d) Changes to This Policy

We may update this Privacy Policy from time to time. Any material changes will be reflected by updating the “Last Updated” date above. Continued use of Inkko after such changes constitutes your acceptance.

8. Disclaimer of Warranties & Limitation of Liability

INkko is provided “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS.” To the fullest extent permitted by law:

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and quiet enjoyment.
We do not guarantee that Inkko will meet your requirements, operate without interruption, be secure, error-free, or virus-free.
Any use of Inkko is at your own risk.

Limitation of Liability

In no event shall Paolo Straet, our officers, employees, or affiliates be liable for any:

Indirect, incidental, special, punitive, exemplary, or consequential damages (including loss of profits, data, goodwill, or business opportunity).
Damages arising from your inability to access or use Inkko.

Our total cumulative liability to you for any claim related to Inkko or these Terms shall not exceed the greater of (a) €10.00 or (b) the amount you paid us for Inkko in the six (6) months prior to the claim. (Note: Inkko is currently free; therefore, liability is capped at €10.00.)

9. Term and Termination

These Terms take effect when you first use Inkko and remain in force until terminated.

You may terminate these Terms at any time by permanently ceasing to use Inkko.
We may terminate your access immediately and without notice if you breach these Terms or for any other reason.

Upon termination, your license to use Inkko ends, and you must stop all use. Provisions that by their nature survive termination—such as Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and Miscellaneous—shall remain in effect.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Belgium, excluding its conflict-of-law principles.

Any dispute, claim, or controversy arising from or relating to Inkko or these Terms shall be subject to the exclusive jurisdiction of the courts of Liège, Belgium.

11. Miscellaneous Provisions

Entire Agreement: These Terms, together with this Privacy Policy, constitute the entire agreement between you and us regarding Inkko and supersede all prior agreements.
Severability: If any provision is found invalid or unenforceable, the remainder of the Terms shall remain in full force.
No Waiver: Failure to enforce a right does not constitute a waiver of that right.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
